1. Messaging Terms & Conditions

By providing your phone number and opting into SMS communications, you agree to receive informational text messages from Beacon Grove Web Design. These messages may include appointment reminders, project updates, account notifications, and other client-specific communications. Message frequency will vary depending on your engagement with our services.

You can opt out of our messaging service at any time by replying with the word STOP to any message. After you send the STOP message, we will send you one final confirmation text, and you will no longer receive text messages from us.

2. Services Provided

Beacon Grove Web Design provides custom web design, development, hosting, maintenance, SEO, and related digital marketing services. Our focus is on crafting high-performing websites for small and medium-sized businesses. The specific scope of services for each client will be detailed in a separate, written client agreement.

3. Intellectual Property

The Service and its original content (excluding content provided by clients), features, and functionality are and will remain the exclusive property of Beacon Grove Web Design and its licensors. Our branding, trademarks, and trade dress may not be used in connection with any product or service without our prior written consent.

4. User Responsibilities

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You agree not to:

• Harass, abuse, defame, or harm another person.
• Use the Service to transmit spam, chain letters, or other unsolicited communications.
• Attempt to gain unauthorized access to the Service or its related systems or networks.
• Interfere with or disrupt the integrity, security, or performance of the Service.
• Provide any content or materials for your project that infringe on the intellectual property rights of a third party.

5. Client Content and Materials

Clients are responsible for all content they provide, including text, images, logos, and other materials. By providing these materials, you represent and warrant that you own or have the necessary rights and permissions to use them. You agree to indemnify and hold Beacon Grove Web Design harmless from any claims, damages, or legal fees arising from the use of materials you provide.

6. Payments and Fees

All project fees, payment schedules, and deliverables will be explicitly defined in a separate client agreement. Payments are typically structured around project milestones. Late payments may be subject to late fees as outlined in the client agreement. Unless otherwise specified, all fees paid are non-refundable. Please refer to your client agreement for specific details on your payment obligations and our refund policy.

7. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Beacon Grove Web Design, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

8. Limitation Of Liability

In no event shall Beacon Grove Web Design, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of a possibility of such damage.

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions, as our business is registered there. All parties agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Delaware.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
